U.S. Supreme Court Nominee Brett Kavanaugh Has The Anti-Gun Left Scared To Death

Protests against Brett Kavanaugh will likely increase in intensity.

Its true, U.S. Supreme Court nominee Brett Kavanaugh has gun control crowd scared to death.

Michael Bloomberg is so desperate to keep Kavanaugh off the high court that his organization is set to employ any and all tactics necessary.  His leftist “Everytown for Gun Safety” has launched an official investigation into ties between President Trump, Kavanaugh and the NRA.

Everytown has filed Freedom of Information Act (FOIA) requests for communications between the Justice Department and the NRA hoping to snag Kavanaugh. The left-wing magazine Mother Jones reports that the FOIA requests are apparently an effort to discredit Kavanaugh.

“Kavanaugh’s judicial record demonstrates a dangerous view of the Second Amendment that elevates gun rights above public safety,” Nick Suplina, Everytown’s managing director for Law and Policy said. “The American people deserve to know whether the NRA played a role in his selection.”

Gun Controllers Waging War On Kavanaugh

Exactly what information Everytown is seeking is unclear. Presumably, Bloomberg would not be spending money on FOIA requests if he did not think they would yield results.

Disturbingly, the FOIA requests are just one of many tactics gun controllers are using against Kavanaugh. To that end, the Brady Campaign to Prevent Gun Violence is preparing a list of questions. Democrats on the Senate Judiciary committee will presumably ask Kavanaugh the questions.

Therefore, the idea behind the list is to trick Kavanaugh into saying something that will turn Republicans against him. Not surprisingly, the Brady campaign did not supply the list to the media.

Former Congresswoman Gabby Giffords (D-Arizona) has reportedly launched a digital campaign to get voters to call Senators. The obvious purpose of the campaign is to pressure Senators into voting NO on Kavanaugh.

Giffords’ group has reportedly hired a service that automatically connects callers to Senator’s offices. Such a service will apparently make it look like there is a grassroots campaign against Kavanaugh.

“Judge Kavanaugh gives the NRA’s extremist views a seat on the Court — we must block his nomination. Call your senators and tell them to vote NO on Kavanaugh.” – Giffords tweeted on July 10. Presumably, hundreds of such calls would convince Senators to vote no.

Why Gun Controllers Are Scared To Death Of Brett Kavanaugh

Therefore, it is easy to see why gun controllers are scared of Brett Kavanaugh. Surprisingly, Mother Jones admitted the federal judge can “deal a big blow to gun control.”

“He thinks assault weapons are within the scope of the Second Amendment, which puts him way out of step with the Supreme Court and circuit courts that have considered this issue,” attorney Avery Gardiner said of Kavanaugh. Gardiner believes that Kavanaugh thinks assault weapon bans are unconstitutional.

Kavanaugh was the only member of a United States Court of Appeals panel for the District of Columbia who voted to overturn an assault weapons ban. Two members of the panel reportedly ruled that the Second Amendment does not protect guns branded assault weapons by liberals – Kavanaugh dissented.

A challenge to a Massachusetts assault weapons ban is probably going to the Supreme Court, Gardiner notes. The ban was apparently upheld in a case called Worman v. Baker. Worman v. Baker is reportedly being sent to the First Circuit Court of Appeals.

The case will go all the way because the only appeal from the First Circuit is the Supreme Court. Kavanaugh would presumably be a justice by the time Worman v. Baker reached the Supreme Court.

How Kavanaugh Can Stop Gun Control

The U.S. Supreme Court might start hearing challenges to gun control laws with Kavanaugh on the bench. The court can hear more Second Amendment cases perhaps because Kavanaugh wants to hear them.

The Supremes have refused to hear several gun cases, including Peruta v. San Diego County, in recent years. Peruta was a challenge to San Diego County’s requirements for concealed carry permits. Consequently, this kept the court from expanding the right to bear arms.

Gardiner thinks Kavanaugh will give Second Amendment supporters on the court enough votes to hear the cases. Previously, a majority of the court’s members refused to consider Second Amendment cases.

“I think Judge Kavanaugh could become the fourth vote,” Gardiner said. The Supreme Court has not heard Second Amendment cases because it takes a vote of four Supremes to review a case. In recent years, a majority of justices, led by retiring Anthony Kennedy, allegedly refused to hear gun cases.

Therefore, Gardiner thinks Kavanaugh will force the court to start hearing Second Amendment cases. Kavanaugh can achieve that because he would increase the number of justices sympathetic to the right to bear arms. Obviously, pro-gun decisions are not guaranteed with Kavanaugh, but they will become more likely.

Is Kavanaugh The Last Chance To Stop Gun Control?

As a result, Second Amendment supporters had better start calling their U.S. Senators if they want a friendlier Supreme Court. Brett Kavanaugh might be the last chance to get a friend of the Second Amendment on the nation’s highest court for the foreseeable future. The alternatives are historically dreadful.

Some polls predict Democrats will win control of the Senate in the November midterm election. If that occurs, there would probably be no new Supreme Court Justices until 2021 and certainly no pro-gun nominees. Senate Democrats, now in the majority, will simply reject any new Trump nominees.
