Mayor: Anything Not Permitted Under Law Is Now Banned (And That Includes Gardens)

Columbiana, Ohio, is the latest city to debate the legality of gardens, even if the two sides can’t agree on what is up for discussion.

Resident Tony Dolan claims that the right to garden on a homeowner’s property is at stake. The Columbiana city council at one point considered a proposal that would have restricted gardens to back yards, although that language was struck.

“It has been frighteningly apparent that we in this city have given our freedoms up in ways that we never really saw coming,” Dolan wrote at the Columbiana for/against Chickens Facebook page.

Mayor Bryan Blakeman claims the gardening ordinance is being considered because, technically, gardening currently is banned.

“Right now, if there is not something expressly in this code that says that you can have one, you technically can’t,” Blakeman told the Salem News.

The newspaper likewise reported that “if something is not permitted it is prohibited.”

But at least one councilmember is siding with the gardeners.

“People have been growing gardens for as long as I can remember in Columbiana, and have never had a problem,” Councilman Dick McBane said.

McBane also expressed concern about the argument that if something isn’t permitted, it’s prohibited, the newspaper reported.

“I think we are over-using this and using it as a convenient way to try to stop something,” he said.

The city’s planning commission considered banning front-yard gardening because it attracts wildlife – something that could create traffic problems on roads, commission member Tucker Cope Jr. told the newspaper.

Vegetable gardening is not the only activity facing restrictions in Columbiana; the city council is considering an ordinance that would make roosters illegal.

“City Council is only considering allowing chickens, hens only and no roosters,” McBane wrote at the Columbiana for/against Chickens Facebook page.

Columbiana, located south of Youngstown, is but the latest city where front-yard vegetable gardens have generated controversy. The Miami Shores, Fla., council banned such gardens, and a court upheld the law.

  1. I have a problem with anyone, let alone the government, saying that if they don’t have a rule ALLOWING me to do something, then I would be a criminal if I choose to do something. That’s quite the catch all, that I would need to go prostrate myself before the king, to do something as simple as grow food, a life sustaining element. No one is allowed to deprive you of LIFE, LIBERTY, and the PURSUIT of happiness.

  3. I can see the ordinance of not having roosters as being sensible given the noise they can make all day long. When people choose to live in a community they don’t always have the decency to be a neighbor that doesn’t interfere with other’s peace. Roosters and guinea (sp) are a bit more than one should expect a neighbor tho deal with. Just like a barking dog.
    That being said the garden discussion is just stupid. Of course purple should be”allowed” a garden.

    Time for a new town council they need to be removed and replaced.
    Imagine if all laws and rules were like this.
    If it doesn’t say you can walk on the street it is prohibited.

  5. What stupidity! I hope breathing has been mentioned as allowable! I think it’s high time the council was ousted and a new sensible one elected. Remember the council is supposed to serve the community, not dictate to it. Make sure you attend council meetings, check on what is going on, and stand up and not allow these little dictators get away with these things. If you don’t, you can’t complain.

      Well, if you are aware of the Global Warming scam, breathing will be monitored, and restricted. ‘They’ say that Global Warming is caused by manmade carbon dioxide. Humans exhale carbon dioxide. Trees & plants ‘breathe’ carbon dioxide.
      So, it stands to reason, if carbon dioxide is lethal to the environment, and humans exhale carbon dioxide, then a human culling must be in the plans.
      By the way, the ‘plan’ is called Agenda 2032, formally called Agenda 21. You may read all about ‘their’ plans for humanity on the United Nations website. . . . . . .

  6. What is going on in this country? Both of the city’s mentioned in this article are in conservative ran states. Where are the conservatives standing up? Stop this shit!!! What a stupid excuse for not having front yard gardens “because it attracts wildlife and could cause problems on the roadway” come on, does the asshole who said that really think that we believe his excuse?
    Really it was probably some pointy headed PETA progressive liberal with to much time on their hands, that did not like seeing a garden in someones yard and complained about it to enough other pointy heads with nothing better to do!!!!

  9. So let me get this straight…we forbid people who want to work hard, show initiative, and help support themselves by growing food for their own needs or to share with others. They also get exercise and fresh air that benefits their health. Instead, we dole out aid for food stamps, medical or whatever and charge it to the rest of us! Is there a rule ALLOWING the supporters of this idiocy to be that stupid?
