Showdown: Sheriff Blocks FDA Inspectors From Raw Milk Farm

Federal agents subjected a farmer to harassment and warrantless searches simply for producing raw milk, but a county sheriff took the farmer’s side and blocked federal agents from the property – and the sheriff is now speaking out.

The US Food & Drug Administration (FDA) and Department of Justice (DOJ) took the actions four years ago simply because the farmer was providing raw milk to an organic food co-op. The story is receiving renewed coverage because the Indiana sheriff, Elkhart County’s Brad Rogers, wrote a 600-word explanation for a local newspaper as part of his “Ask The Sheriff” series. Off The Grid News previously reported on the dispute.

Participants paid money into the co-op and, in return, received raw milk.

“It appeared to be harassment by the FDA and the DOJ, and making unconstitutional searches, in my opinion,” Rogers wrote of Uncle Sam’s treatment of the farmer in a column for the Goshen News.

Rogers said he became involved in the case in 2011 when the farmer complained to him.

“Specifically, the FDA was inspecting his farm without a warrant as much as every two weeks,” Rogers wrote. “Typical inspections occur annually. The Department of Justice (DOJ) had subpoenaed him for a grand jury in Michigan in which he was to bring his production documents. The Feds wanted to make this farmer an example.

“My research,” Rogers added, “concluded that no one was getting sick from this distribution of this raw milk. It appeared to be harassment by the FDA and the DOJ, and making unconstitutional searches, in my opinion. The farmer told me that he no longer wished to cooperate with the inspections of his property.”

Sheriff Confronts Feds

The sheriff then emailed a lawyer at the Department of Justice, writing:

“I understand that you have made recent requests to (the farmer) for documents and to appear before a grand jury, and he has had a number of inspections and attempted inspections on his farm within Elkhart County. This is notice that any further attempts to inspect this farm without a warrant signed by a judge, based on probable cause, will result in federal inspectors’ removal or arrest for trespassing by my officers or I. In addition, if any further action is taken by the federal government on (the farmer), while he is in Elkhart County, I will expect that you or federal authorities contact my office prior to such action. I will expect you to forward this information to your federal associates, including the FDA.”

Shortly after the email was sent, the farmer received a certified letter from the DOJ that said his grand jury subpoena had been cancelled. No federal inspectors have visited the farm since 2011.

“Your local elected officials … can stem the tide of federal overreach if they apply just a little backbone in supporting and defending the Constitution. Expect it! Demand it!,” Rogers wrote. “Some bloggers and natural food writers have hailed me as a hero. I’m no hero. I’m just doing my job.

“Whether you are conservative or liberal, I will be a guardian of the Constitution for you, and will not stand idly by while the rights of citizens of my county are trampled, whether by criminals or an overreaching government.”

Rogers also said the government has no business preventing people from drinking raw milk.

“Many of our parents/grandparents drank raw milk and survived,” he wrote. “There are risks with raw milk, but careful handling and storage will mitigate the risk. Many people believe that raw milk is healthier to drink than the pasteurized version. There is no law in Indiana that prohibits the distribution of raw milk in this fashion. In short, I don’t believe the government should be our nanny and telling us what we can or cannot drink/eat.”

  1. Finally …. a Sheriff who understands his responsibilities to uphold the Constitution and his responsibilities as the highest elected law enforcement official in his county. I applaud Sheriff Brad Rogers for his loyalty. The feds have no business sticking their FDA or DOJ noses in 10th Amendment business! There, I’ve said it!

  3. The sheriff is a modern day hero, and one certainly hopes his constituents have the good sense to re-elect him to office on a continuing basis. I come from a long line of Quaker dairy farmers, and firmly believe in the benefits of raw milk. Keeping the cows and their surroundings healthy and clean is going to be better for the cows and for the milk — and then you don’t have to worry about cleaning up the damage after the fact.

    My family moved to Missouri in 1959 when I was 10 years of age. I started drinking fresh cow’s milk, eating freshly churned butter, and eating foods prepared with fresh cow’s milk at that time and continued to do so until the age of 18 at which point, after graduating high school, I joined the United States Navy. I am now about to turn 68 and have used every opportunity to obtain fresh milk that I could. There may be risk involved but I doubt that they are as significant as the risk associated with drinking and using the pastureized, homogenized, watered down stuff that you purchase in the store. I think the whole problem with the FDA and DOJ is that they don’t get all the tax revenue that is connected with the store bought stuff that fills their greed ridden coffers and really has nothing to do with their concern for our health and welfare. I am thankful that there are elected officials like this sheriff who will stand up for the rights of the citizens against an obtrusive and self empowered agency or agencies of the, to full of itself, federal bureaucracy. We the People need more of our own to stand up with people like this sheriff and put a stop to bureaucratic over reach. You may have noticed that I used bureaucrat and not government. That is because you and I are the government, not the elected officials who are hired to work for US. Thank you too, Heather Scott, for representing US and for being a shining star in the gloom of bureaucratic over reach. Keep up the good work.

    • I use raw goats milk, I told the man I get it from that it is “for my pets”… He asks no questions, and I leave it that way. I prefer raw milk because of the good enzymes and is pure. I am 70 and fell last year. When I went down, I knew I’d broken something as I went down hard. After x-rays were taken, there were no broken bones. I know raw milk better for you and was also raised on it.
      I resent the government interference into my ability to buy what I feel is good for me.

  5. My family drank fresh cows milk all our lives. I took agriculture in high school & raised a dairy cow which I sold milk & butter to put me through. Every one that drank the milk lived to be in their 90’s with no complications. Personally I don’t like the taste of processed milk. Hooray for this sheriff for standing up for our rights. The feds sure don’t. So keep up the good work. I applaud you.

  6. All government officials . . who by the way are required to take an oath to the constitution. . . have not only the right but the duty to interpose especially when Federal “bullies” are involved. May his tribe increase and our knowledge grow.

    I don’t drink raw milk, and I wouldn’t give it to my kids. I think people are crazy to drink it. That being said, I don’t think it’s anybody’s right to stop others if that’s what they want to do. And from this perspective, it appears as though the FDA was bullying the farmer because they had no legal right to stop using him. God bless this sheriff for doing his jo when so many are so impotent on things like this.

    • Michael, you are unusual. See the modern idea is that if you wouldn’t do it you would want to force other to not do it. Its a collectivist attitude. I’m the same way. I’m too used to store bought milk, but, regardless, I don’t believe government has the right to tell us what we can or can’t do as long as it doesn’t harm others. …and it appears that the feds don’t either. The e-mail the sheriff sent backed the feds right down. Now, if they had a case they would not have backed down. Since they did back down, it shows they had no case. As such WHAT THE HECK WERE THEY DOING HARRASSING A PEACEFUL FARMER??? Evil. The are just plain evil. They had not case, they probably just wanted to try and extract money from this guy. …and you have to wonder: if the government doesn’t want you to do it, then it must be good for you and bad for them. Brad Rogers must be one heck of a patriot.


  8. I know the FDA has our best interests in mind when they ban raw milk and at the same time allow azodicarbonimide in bread dough …. along with some 80,000 other chemicals they have no idea about! Too much government and too little smarts!

  11. Now sheriff I commend you upon your taking your oath seriously. Now please expand upon your seriousness and end the other unconstitutional actions regarding the federal courts over reach. Federal courts have no jurisdiction whatsoever in any way outside of their constitutionally limited capacity which is the federal area comprising ten square miles in washington DC and the territories such as the Virgin Is., Guam, PuertoRico, Northern Marianas, They have no jurisdiction to enter judgments upon anyone or anyone’s property real or personal. People of the union are state citizens, not federal citizens unless they reside within the geographically area designated by the constitution. This means the FDA,DEA, FBI, DHS,DOE,and every other federal alphabet agency and their employees have no jurisdiction outside of DC and the other territories. The charade has gone on for too long and has gotten entirely out of control. The only way they have been able to continue this deceit and ursurpation of power has been to pretend as if the truth does not exist. When they are caught red handed by someone doing these things who has them by the scruff of their neck, they ignore, stay silent and take no action regarding any court motions and claims filed by those who are fighting the federal gov’t and just roll over them claiming their arguments are frivolous. When teh truth is that the federal gov’ts arguments are frivolous and outright treasonous. I don’t know how sheriffs are compensated, hopefully sheriffs do not depend upon the federal gov’t for their paycheck.

    • Let us pray for the safety of this sherrif and the farmer and all those involved. The Lord told us to also pray for our “beloved enemies”. The lake of fire was created for the devil and his angels, not for people’s souls, but there will be people like Stalin, Mao, Hitler, etc souls in there. No one would want to subject their own soul to that, but they need to have “their eyes to see”.

    • The problems in this country relate to parential responsibility being relegated to “specialists”. Teaching our children the fear of God (which is to know the One who is our source, which will cause them to come to love Him and desire to please Him) and to live responsibly.
      Evil men are the source of the “soulutions” that “make life better” for us (to make more money!!!) and for the “better” schooling for our children. These “specialists”, to whom we have entrusted our children for their schooling, indoctrinate (teach) our children with the learning that is devoid of God and truth, teaching them that up is down and down is up. One of the basic tennets of their presentation is that government is the source of all good, so the more we have, the better things will be. Another is that the injustices of life can be resolved by the government because everyone should have everything they need as rights guaranteed by the government. It is no wonder then that the greatest percentage of young voters are enamored by an Obama that sells them an attractive package or a Sanders who sell equality for all.
      We would even rather have a “quick fix” conservative strong man to get things going again than look at where we are and what the thief, murderer and destroyer, of which Jesus warned us, has sold us and repent, turning to the One who is life. (John 10:10)
      It is very refreshing to hear stories like this, but unless we turn, they are going to be fewer and farther inbetween.

  15. It is so refreshing to find the people elected or hired to protect our rights doing just thatn. I have felt that our rights have been slowly taken away from us usually hidden within bills that are passed. It is hard to trust any political figure in these days and for many years in fact. What has happened to our rights provided by the American Constitution?
